General Terms and Conditions of Trade

 

The following terms and conditions (GTCT) apply for orders from the publisher “edition steinlach”. We do not recognize any conditions deviating from these regulations, unless they are confirmed by us in writing. This also applies even if we execute deliveries without reservation in knowledge of deviating or supplementary terms and conditions of the customer.

 

 

1. Conclusion or Cancellation of a Contract

1.1 By ordering, the buyer agrees to these terms and conditions. The order is a binding offer. The contract of purchase is concluded when the order arrives us. We are entitled to withdraw from the contract if the work ordered can not be delivered in the foreseeable future or if the buyer did not comply with his obligations under previous contracts and there is reasonable suspicion of recurrence.

 

 

2. Delivery, Retention, Shipping Charges

2.1 The delivery will be carried out to the address specified by you.


2.2 We deliver as fast as we can. However, the delivery time can add up to ten days after receipt of order. Cases of force majeure may lead to delays in delivery.


2.3 For commercial customers shipping is at risk of the recipient. This applies regardless of who pays for the shipping expenses. If the purchaser is an entrepreneur, the risk passes with transfer of the delivery from the person responsible for the transport, to him. At request and expense of the purchaser, we will insure deliveries against the usual transport risks. We indicate to the purchaser that for asserting any claims against the carrier or its insurer may deadlines must be observed. The risk also passes to the purchaser when the shipping of the order,  its delivery or pickup is delayed for reasons for which the purchaser is responsible for or if the purchaser has otherwise failed to accept and receive the delivery.

 

2.4 We are entitled to partial deliveries and subsequent deliveries. If subsequent deliveries are required (for example, when an old edition is sold out and a new edition still in print), you will receive a notification.


2.5 For delivery delays no claim can be asserted against us.


2.6 We reserve the right not to deliver ordered books when they are not available. We will inform you immediately in this case.


2.7 We appreciate your interest in our offer. Within Germany, the shipping costs for private customers are free. You pay by cash, in advance – and we will take care that the goods are packaged well, brought to the post-office and sent to you you as soon as possible, upon receipt of payment. For the delivery to all other countries, we charge the shipping costs. The buyer has to pay for custom duties as well as any applicable foreign taxes.

 

2.8 If the buyer may want special forms of shipping like for example airmail, express shipment, a courier, registered mail, a transport insurance or the like, he has to pay for additional costs.

 

 

3. Order Confirmation and Pricing

3.1 Invoice and delivery note also count as order confirmation at the same time.


3.2 For orders via Internet, we send an acknowledgement of receipt to the email address you provided.


3.3 Changes and errors can not be excluded considering the mentioned prices.


3.4 For books subject to resale price maintenance, the prices effective on the day of delivery are valid.


3.5 All prices are in Euro and include the VAT in force. If necessary, the following costs will be added to these final prices:
•  Postage and packing costs (2.7.),
•  Additional fees for special shipping forms (2.8.),
•  Bank charges for non-cash payments from abroad (4.4.).

 

 

4. Payment and Title Retention

4.1 The invoice amount is due immediately by cash for payment. Other payment terms are only valid if they have been confirmed by us in writing.

 

4.2 Discount deduction is not allowed.

 

4.3 Private customers can pay only by cash in advance or via the online payment system Paypal. The shipment of goods is carried out on weekdays immediately after receipt of payment. In case of cashless payments from abroad the fees therefore have to be fully paid for by the buyer. The shipment to the book trade is possible on bill, subject to prior agreement and carried out on previously arranged price condition terms.


4.4 Payment by credit card or cash on delivery are not possible.


4.5 When ordering from abroad and when we deliver abroad, we can create an advance invoice and post the shipment only after receipt of payment.

 

4.6 The buyer is not entitled to withhold or to balance withcounterclaims, unless the claim is undisputed or legally established.

 

4.7 If you default in payment, we can charge interest for default. This amounts to five percent for normal consumers and eight percent for commercial customers over the current base lending rate according to § 247 “BGB” ((Bürgerliches Gesetzbuch (= German Civil Code)).


4.8 For unjustified deductions and demand notes when can calculate handling charges.


4.9 Until they are fully payed for, the goods remain our property (reservation of proprietary rights (“Eigentumsvorbehalt” according to § 449 “BGB” (Bürgerliches Gesetzbuch (= German Civil Code)).

 

 

5. Incorrect or Faulty Delivery

5.1 Wrongly delivered items or goods with obvious defects have to be returned, by stating the reasons or with precise indication of the wrongly delivered title, within one month after receipt, to:

5.2 We will bear the costs of returning if the the complaints are justified. We will exchange the wrong and faulty goods with faultless products. A refund or credit entry is not possible. Additional claims are excluded, especially compensation for damages due to delayed or failed delivery.


5.3 3. Transport damages are to be confirmed immediately upon receipt of package by the messenger or transporter and have to be report within 24 hours by the “Deutsche Post AG” (German Mail) or the shipping company in writing. This applies even if the packaging has no external damage.

 

 

6. Right to Return

6.1 Consumers are entitled to an unconditional right of return within two weeks after receipt of delivery. This applies to all goods except for those which were signed at the request of the customer or provided with a personal dedication of the author/authors.

 

6.2 A right of withdrawal is excluded.


6.3 The return does not have to be justified. To observe the deadline, a dispatch in time is sufficient. If you have already paid the bill when you return the ordered goods then the full purchase price will be refunded, as long as the goods arrive at the publisher in perfect, re-saleable condition.


6.4 If you wish to exercise the right of return, you are bound to return the goods at your own expense to edition steinlach, Koebisstrasse 20, 16548 Glienicke. If the goods are no longer in perfect, re-saleable condition, the publisher is entitled to a claim for compensation.


6.5 All items listed under section 6 apply only to consumers. The law defines “a consumer” as (§ 13 BGB (Bürgerliches Gesetzbuch = German Civil Code)) "any natural person who enters into a transaction for a purpose that can neither be assigned to commercial nor independent, non-wage, professional activity".

 

 

7. Liability, Warranty and Guarantee Conditions

7.1 We are only liable for intent or gross negligence. We do not issue a guarantee considering quality or durability. We also do not warrant for the content of the media we distribute. Descriptions objects are given to the best knowledge and in all conscience, the use is, however, at your own risk.

 

 

8. Price Fixing

8.1 This applies by delivery to resellers: If the purchaser sells the work ordered in mint condition, he has to observe the German price fixing provisions of works with a fixed price.

10. Privacy, Digitization

10.1 We are entitled to data processing and electronic storage of client data under the provisions of the Data Protection Act (German “Datenschutzgesetz”).

 

10.2 You agree that the German Post AG (German Mail Service) tells us the correct current address, if a postal item could not be delivered to the address previously known (Postal Service Privacy Regulation (§ 4 Postdienst-Datenschutzverordnung).


10.3 The digitizing, copying and any other form of reproduction and publication of book content is not allowed, unless the publisher agrees explicitly in writing to a further distribution of content of any kind.

 

 

11. Bank Details

11.1 Please pay for deliveries of goods that can be obtained from our publishing house to any bank account stated on the bill.

 

 

12. The Place of Fulfilment and Jurisdiction

12.1 The place of fulfilment and jurisdiction is Glienicke/Nordbahn, administrative district Oberhavel.

 

 

13. Final Provisions

13.1 The contract of purchase is subject to the law of the Federal Republic of Germany under exclusion of the UN Convention on Contracts for the International Sale of Goods and the regulations for German international private law.


13.2 If any provision of this contract should be completely or partly ineffective, the validity of the remaining provisions shall not be affected. Instead of the invalid provision, the legislation that comes closest to the ineffective provision by spirit and purpose of the law applies.
